Since you've already agreed to the licensing terms, chances are that they won't take it back for that reason. They might have a 30-day unconditional return policy or something. If that's the case, take it back. Then go buy a xp-loaded machine or buy a vista-loaded machine, tell them you don't accept the licensing terms and they'll be forced to take Vista off -- then you can buy XP. If they refuse to, tell them they legally have to and that you'll have your lawyer on them faster than they can say upgrade.
Of course, the best option is to go for GNU/Linux. I suggest Ubuntu.
